1. Acceptance of these Terms

By creating an account, accepting these Terms in the portal, or using TBS, you agree to follow these Terms and the Privacy Policy. If you do not agree, do not activate or continue using an account.

Your sponsoring company or institution may have a separate agreement with TBS. That agreement does not remove the responsibilities applying to your individual account.

2. Eligibility and learner responsibility

The current learner experience is intended for people aged 18 or over. You must provide accurate registration information and use TBS only where you are legally permitted to do so.

TBS is an educational experience. It does not guarantee employment, promotion, performance ratings, salary outcomes, or any particular workplace result.

3. Organisation-sponsored access and Access Codes

A company, educational institution, or other organisation may purchase and distribute unique TBS Access Codes.

• Each code may activate one account.
• The code is used once during registration and is not needed for later sign-in.
• You must not sell, publish, or knowingly share an unused code with an unauthorised person.
• A code may be revoked or expire before use.
• Once claimed, it remains linked to the account, code batch, and sponsoring organisation for access management and audit.

Sponsorship grants access; it does not transfer ownership of TBS or your credentials to the sponsor.

4. Accounts, credentials, and security

You are responsible for protecting your email or legacy username, password, device, and account session. Do not impersonate another learner or allow another person to complete the journey under your identity.

Report suspected unauthorised access through the official TBS support channel or your sponsoring organisation. Identity or sponsor verification may be required before access is changed.

5. Acceptable use

You agree not to:

• bypass Access Code, membership, authentication, scoring, or progression controls;
• use automation to create accounts, scrape content, overload services, or farm scores;
• submit unlawful, abusive, discriminatory, threatening, or intentionally harmful content;
• probe, reverse engineer, interfere with, or exploit the service except where law expressly permits;
• redistribute substantial game content, media, software, or feedback structures without permission;
• violate another person’s privacy, intellectual property, or legal rights.

6. Educational content, activities, and AI-assisted feedback

TBS presents fictional and realistic workplace situations for educational practice. Guidance is general learning support, not legal, medical, financial, psychological, human-resources, or professional advice for a specific dispute.

Some activities may use automated or AI-assisted analysis. Automated feedback can be incomplete or mistaken. Use judgement and seek a qualified person when a real situation has significant consequences.

Skill scores are based on activities mapped to each skill. A skill with no completed evidence is shown as “Not yet assessed.” TBS may improve content, mappings, and scoring while preserving fair backend-authoritative records.

7. Privacy and sponsor reporting

The Privacy Policy explains how TBS handles account, profile, progress, skill, reflection, chat, and technical information. Sponsors may receive participation, progress, completion, and skill-development information where this forms part of the programme and is disclosed to learners.

Raw private reflections, private chats, and full AI conversation transcripts are not sponsor-visible by default. Broader reporting requires an appropriate product, contractual, and privacy decision.

8. Intellectual property and licence

TBS, its story, characters, game design, software, images, audio, video, text, feedback structures, and branding belong to Standout PVT Ltd, Luminary Learning Solutions, and/or their licensors.

While access is active, you receive a limited, personal, non-exclusive, non-transferable, revocable licence to use TBS for its intended educational purpose.

You retain rights in original content you submit. You grant TBS the limited rights needed to store, process, evaluate, display, secure, and administer that content as part of providing the service.

9. Service availability and changes

TBS may be unavailable during maintenance, updates, incidents, or circumstances beyond reasonable control. Features, activities, media, and supporting services may be corrected or improved.

Reasonable efforts will be made to preserve valid progress, but uninterrupted or error-free operation cannot be guaranteed.

10. Suspension, expiry, and termination

Access may be suspended or ended if an account is inactive, a membership expires, the sponsor’s agreement ends, access was obtained improperly, these Terms are breached, or suspension is reasonably required for security or legal compliance.

Suspension does not automatically delete valid progress. Retention and deletion are handled under the Privacy Policy and applicable agreements.

11. Disclaimers and legal limits

TBS is provided on an “as available” basis to the extent permitted by law. Educational outcomes depend on many factors outside the service. Nothing in these Terms excludes rights or responsibilities that cannot legally be excluded.

12. Changes to these Terms

TBS may update these Terms when the service, reporting model, legal requirements, or business model changes. Material updates will use a new version and may require renewed acceptance before game access.
